Ontario's police oversight body has cleared Niagara police officers involved in a fatal shooting in September.

On Sept. 4, a 52-year-old man was fatally shot by a Niagara Regional Police Service officer in his apartment in Port Colborne.

SIU Director Joseph Martino determined there were no reasonable grounds to believe that any of the officers comported themselves other than within the limits of the criminal law in connection with the man’s tragic death, the SIU said in a news release.

There was no basis for proceeding with charges in this case and the file has been closed, the SIU said.

The incident involved a noise dispute between neighbours in which one person threatened the other with a knife.

The man with the knife barricaded himself in his apartment, after which an emergency task unit and negotiator made unsuccessful attempts to resolve the matter safely.
